Chishimba Kambwili acquitted in defamation case

The Lusaka Magistrate Court has acquitted former National Democratic Congress -NDC- President Chishimba Kambwili in a case where he was accused of defaming the President and Lusaka businessman Valden Findlay.

In this matter, New Congress Party leader Peter Chanda took Mr. Kambwili to court for defaming the President and Mr. Findlay.

The decision by the court was as a result of the complaint and accused’s decision to settle the matter amicably.

When the matter came up for continued defence before Magistrate Felix Kaoma, Emmanuel Mwansa who was privately prosecuting the matter informed the court that the parties had decided to iron out their differences amicably.

Mr. Mwansa asked the court to invoke Section 88 of the Criminal Procedure Code which requires a public prosecutor under the instructions of the Director of Public Prosecutions with the consent of the court to discontinue a case after an accused person has been placed on defence.
