Concourt issues a decision about parliamentary by-elections

According to the Constitutional Court, a person who contributes to the annulment of parliamentary election results is ineligible to run for office again.

This relates to a case in which former lawmakers BOWMAN LUSAMBO of KABUSHI and JOSEPH MALANJI of KWACHA challenged the Electoral Commission of Zambia’s (ECZ) decision to prevent them from running in the two constituency’s by-elections again.

The decision was made today by Deputy President MARGARET MUNALULA of the Constitutional Court.

The Court cited article 72 sub-article four of the constitution, which states that, subject to the conditions outlined in article 72 sub-article two, a person who creates a vacancy in the National Assembly is NOT entitled to run again.

A violation of a specified code of conduct is one of the grounds listed in article 72, subsection 2, of the Constitution for barring a person from running again in parliamentary by-elections.

On October 21, 2022, there were by-elections for the Kabushi and Kwacha.
