In the case involving former Treasury Secretary FREDSON YAMBA, who is accused of intentional disregard for the legislation governing the management of public property, the state has been compelled to alter and combine two counts.
Following a request from the defense attorneys, Lusaka Resident Magistrate IREEN WASHIMANGA issued the ruling today.
According to Magistrate WASHIMANGA, in order to prevent duplication, the charges based on Sections 77 and 82 of the Public Finance Management Act must be combined.
The defense bemoaned the dishonesty in the way Mr. YAMBA was accused of committing the crime.
Together with the former minister of foreign affairs, JOSEPH MALANJI, Mr. YAMBA is accused of eight counts of possession of property thought to be the proceeds of crime.
According to the allegations, Mr. YAMBA broke the law when he authorized the transfer of 45,800,000 Kwacha to ZAMBIA’s mission in Turkey for the acquisition of real estate between January 1 and August 31, 2021.
In the meantime, Mr. MALANJI is accused of having custody of a Bell 430 Jet Ranger Helicopter between January 1, 2020, and August 31, 2021, which is considered to be proceeds of crime, among other things.
