State will pay late prosecutor Nsama’s family K1.5 million in damages

The State will provide the late State Prosecutor Nsama Chipyoka Chipyoka’s family K1.5 million in compensation for the pain and suffering brought on by the loss of their loved one.

This relates to a lawsuit filed by Mr. Chipyoka’s family against the State for the loss of a loved one in a shooting in 2020.

Mr. Chipyoka and young Joseph Kaunda were were murdered on December 23, 2020, apparently by police personnel dispatched to disperse UPND supporters.

To show support for President Hakainde Hichilema, who was then in opposition, the UPND supporters had congregated outside Police Headquarters.

During his questioning, Mr. Hichilema was asked about a farm he bought in Kalomo, Southern Province, around 17 years ago.

Mr. Nsama was shot in the chest during the police operation after leaving his office in the National Prosecutions Authority (NPA) building to get a bite from a restaurant.

In the same area between the NPA and the cabinet office, Mr. Kaunda was also shot in the head.

Fanwell Nyundu, a police constable who was later charged with two counts of murder and is currently sitting before the Lusaka High Court, was apprehended after investigations resulted in his arrest.

Later, the families of the deceased filed a lawsuit against the State to recover damages for the loss of their loved ones. However, court records show that a consent judgment has been signed by the State and Mr. Chipyoka’s family.

A consent judgment is a judgment that the parties to the action have resolved and agreed upon.

The parties agreed that the plaintiff should get K1, 500,000 in the consent dated December 5, 2022, which was signed by the Attorney General and ZS Legal practitioners on behalf of Mr. Chipyoka’s family. All of the claims in this action are compensated by the money.

“That upon payment of the above mentioned sum, the plaintiff shall have no further claim against the defendant.

“That should the defendant default on any clauses herein, the plaintiff shall have the liberty to enforce this consent judgement.

The defendant(State) will bear the plaintiff’s costs of K200, 000, ” The judgement reads.
