Russia violated some aspects of UN anti-terrorism treaty: ICJ

The International Court of Justice (ICJ) ruled on Wednesday, that Russia had violated some aspects of the UN anti-terrorism treaty by not investigating the financing of separatist groups in eastern Ukraine in 2014. The court, however, did not order compensation for the attacks carried out in this region, as requested by Kyiv.

It also declined to rule specifically on the case alleging that Russia was responsible for shooting down Malaysian Airlines flight MH17 over Ukraine in July 2014.

The ruling on Wednesday by the ICJ was the first of two verdicts that were scheduled to be delivered this week relating to the conflict between Russia and Ukraine.

The case was filed by Ukraine in 2017, predating Russia’s full-scale invasion in 2022, accusing Moscow of financing terrorism in eastern Ukraine and of violating international treaties against discrimination in Crimea after its annexation of the peninsula.

The court concluded that the information provided by Ukraine to Russia’s Ministry of Foreign Affairs in 2014, which included the names of several individuals suspected of terrorism financing and details regarding accounts used and types of items purchased with those funds transferred, was sufficient to trigger an obligation by Russia to carry out investigations.

The court then ruled on Wednesday that Russia had violated that obligation by not carrying out the required investigations. The court, however, did not order compensation from Moscow for the attacks carried out in Ukraine’s east, as requested by Kyiv.

It also declined to rule on Russia’s alleged responsibility for the downing of Malaysian Airlines flight MH17 over Ukraine, which Moscow has repeatedly denied involvement.

With regards to the allegations of racial discrimination, the court ruled that the educational system implemented by Russia in Crimea after 2014 violated obligations under the International Convention on the Elimination of Racial Discrimination.

The ICJ is expected to rule on Friday regarding Russia’s objections to its jurisdiction in another case filed by Ukraine shortly after Moscow’s troops invaded in February of 2022. Ukraine argues that Russia launched its attack based on false allegations of genocide being carried out in its country.
